The rules and obligations that govern your use of Employist.

Welcome to Employist ("we", "our", "us"). By accessing or using our website employist.in, mobile experiences, or any related services (collectively, the "Platform"), you agree to be bound by these Terms & Conditions. If you do not agree, please do not use the Platform.
1. User eligibility
You may use Employist only if you:
- Are at least 18 years of age, or 13+ with verifiable parental / guardian consent for a job-seeker account.
- Are legally able to enter into a binding contract under the Indian Contract Act, 1872.
- Reside in a jurisdiction that permits use of an online recruitment platform.
Employers must be a registered legal entity, sole proprietorship, or an authorised recruiter for one.
2. Account registration
- You must provide accurate, current, and complete information at signup.
- You are responsible for maintaining the confidentiality of your credentials.
- One person may not create multiple job-seeker accounts. One legal entity may not create multiple employer accounts without prior written consent.
- You must promptly notify us of any unauthorised use of your account.
3. Employer responsibilities
Employers commit to:
- Post only genuine, currently open positions with accurate role, salary, and location information.
- Not solicit fees, deposits, or personal financial information from candidates as a condition of application.
- Comply with all applicable labour, equal-opportunity, and anti-discrimination laws in India.
- Complete the Employer Verification process before publishing paid or featured listings.
- Respond to candidates in a timely, professional manner.
4. Job seeker responsibilities
Job seekers commit to:
- Provide truthful information in profiles, resumes, and applications.
- Not misrepresent qualifications, employment history, or identity.
- Not use the Platform to solicit business, spam, or send unsolicited marketing.
- Report suspicious job listings or communications immediately.
5. Job posting rules
Every posting on Employist must:
- Describe a real role at a real company or verified recruiting agency.
- Comply with Indian equal-opportunity laws — no gender, caste, religion, age, disability, or marital-status discrimination.
- Not require payment from applicants at any stage.
- Not link to third-party sites that require sensitive personal data as a condition of applying.
6. Prohibited content
You may not upload, post, or transmit any content that:
- Is unlawful, defamatory, obscene, threatening, or violates any third-party right.
- Contains malware, phishing links, or attempts to compromise the Platform.
- Impersonates any person or entity, including Employist staff.
- Constitutes bulk unsolicited communication ("spam").
- Is a multi-level marketing (MLM), pyramid, or crypto-scam recruitment offer.
7. Subscription terms
- Employer subscriptions (e.g., Premium) are billed in Indian Rupees via Razorpay.
- Subscriptions activate only after we receive a verified payment webhook.
- All subscription terms including duration and features are stated on the Pricing page at the time of purchase.
- Renewals, cancellations, and refunds are governed by our Refund & Cancellation Policy.
8. Account suspension and termination
We may suspend or terminate your account with or without notice if we reasonably believe you have:
- Violated these Terms or any linked policy.
- Posted fraudulent or misleading content.
- Harassed, abused, or discriminated against another user.
- Engaged in activity that endangers the safety, security, or reputation of the Platform.
On termination, your subscription entitlements may be forfeited and your data may be retained solely as required by law.
9. Intellectual property
- All Employist trademarks, logos, product designs, and platform code are our exclusive property.
- You retain ownership of the content you upload (resumes, job posts, messages), but grant Employist a worldwide, royalty-free licence to display, index, and use it to operate the Platform.
- Any content generated by our AI features remains subject to the underlying model's usage terms; you are responsible for reviewing AI outputs before acting on them.
10. Limitation of liability
To the maximum extent permitted by Indian law:
- Employist provides the Platform "as is" and disclaims all implied warranties.
- We are not liable for any indirect, incidental, or consequential loss (including loss of employment, wages, business, data, or opportunity).
- Our aggregate liability to any user in any 12-month period is limited to the amount paid by that user to Employist in the same period, or ₹5,000, whichever is lower.
11. Governing law
- These Terms are governed by the laws of India.
- Courts in Kochi, Kerala, India shall have exclusive jurisdiction over any dispute, subject to any applicable arbitration under the Arbitration and Conciliation Act, 1996.
12. Changes to these Terms
We may update these Terms from time to time. Material changes will be communicated via email or an in-app notification. Continued use of the Platform after an update constitutes acceptance of the revised Terms.
